Covid-19 Guidelines, Requirements, and Liability

REMINDER:
It is the responsibility of the individual who has reserved the space (Lessee) to ensure compliance with the following guidelines. If it is determined by officials from the City of Waco  and/or Waco-McLennan County Health District  that any tailgate space(s) is in violation of these COVID-19 Guidelines and Requirements, that group is subject to being cited for these violations, and penalties could result.

Social Distancing
Social distancing means keeping a safe space between yourself and other people who are not from your household. While at Brazos Parking, please stay at least 6 feet (about 2 arms’ length) from other people who are not from your household.
In order to facilitate social distancing, no more than ten (10) people are permitted per numbered tailgate space. If your tailgate space includes more than a single numbered space, then the maximum number of people would be based on the number of tailgate spaces designated for your group.  (e.g. if a group has three individual, numbered tailgate spaces, there may be no more than 30 people allowed for that tailgate group)

Face Coverings (Masks)
In accordance and compliance with State and City mandates, face coverings (masks) are required to be worn in all public areas. 

Waiver of Liability
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is reported to be extremely contagious. The state of medical knowledge is evolving, but the virus is believed to spread from person-to-person contact and/or by contact with contaminated surfaces and objects, and even possibly in the air. People reportedly can be infected and show no symptoms and therefore spread the disease. The exact methods of spread and contraction are unknown, and there is no known treatment, cure, or vaccine for COVID-19. Evidence has shown that COVID-19 can cause serious and potentially life threatening illness and even death.

Brazos Parking, LLC operates and manages a facility for RV Spaces, Tailgate Spaces, Parking Spaces, and contracted third party Food/Beverage Services, all contained within the boundaries of an eight (8) acre site located at 1314 and 1400 S Martin Luther King, Jr. Blvd., Waco, Texas 76704. Brazos Parking, LLC manages and operates this facility under the terms of a Lease Agreement. The named parties for the Lease Agreement executed between Lessors and Lessee are: LESSORS: 1400 MLK, LLC; 1314 MLK, LLC; Vernon R. Davis, individually; and L. Mack Hardin, individually. LESSEE: Brazos Parking, LLC.

Brazos Parking, LLC as Lessee, and the Lessors named and listed above, cannot prevent you [or your child(ren)] from becoming exposed to, contracting, or spreading COVID-19 while being on the premises of Brazos Parking, and while utilizing the services/facilities located on the Brazos Parking premises, regardless of whether the services are provided by Brazos Parking, LLC or other vendors which may be located on the Brazos Parking premises. It is not possible to prevent against the presence of the disease. Therefore, if you choose to enter onto the Brazos Parking premises for any reason, including for the purpose to utilize services located on the Brazos Parking premises (regardless of the provider) you may be exposing yourself to and/or increasing your risk of contracting or spreading COVID-19.

ASSUMPTION OF RISK: I have read and understood the above warning concerning COVID-19. I hereby choose to accept the risk of contracting COVID-19 for myself and/or my children or others for which I escort to the premises in order to enter the Brazos Parking premises for any reason, which may include utilizing services provided by Brazos Parking and/or services and facilities provided by other independent vendors. The decision to enter the Brazos Parking premises is my(our) independent decision and I(we) accept the risk of being exposed to, contracting, and/or spreading COVID-19 in order to utilize services and the Brazos Parking premises in person.

WAIVER OF LAWSUIT/LIABILITY: I hereby forever release and waive my right to bring suit against Lessee: Brazos Parking, LLC; Lessors: 1314 MLK, LLC; 1400 MLK, LLC; Vernon R. Davis, individually, L. Mack Hardin, individually, and its owners, officers, directors, managers, officials, trustees, agents, employees, or other representatives in connection with exposure, infection, and/or spread of COVID-19 related to enter onto the Brazos Parking premises and utilizing services located on the premises. I understand that this waiver means I give up my right to bring any claims including for personal injuries, death, disease or property losses, or any other loss, including but not limited to claims of negligence and give up any claim I may have to seek damages, whether known or unknown, foreseen or unforeseen.
If I am the parent or legal guardian of minor children, I have the legal right to consent to their entry of the premises and utilization of services, and by signing below, I hereby do consent to the terms and conditions of this Release on their behalf.
I understand and agree that the law of the State of Texas will apply to this contract executed in the City of Waco, County of McLennan.

Best Health Practices To Avoid COVID-19

  • Stay 6 feet away from all people not in your household.
  • Wash hands often for 20 seconds and encourage others to do the same.
  • When soap and water aren’t available, use hand sanitizer with at least 60% alcohol.
  • Please wear a face covering.
    Cover coughs and sneezes with a disposable tissue.
  • Avoid touching your eyes, nose, and mouth with unwashed hands.
  • Disinfect surfaces, buttons, handles, knobs and other places touched often.
  • Stay away from people who are sick.
